User Policy

This Service Agreement (the "Agreement") outlines the terms and conditions governing your use of services provided by HashWhale or its designated affiliates, including but not limited to the HashWhale website www.hashwhale.io, the HashWhale mobile application, and any related applications (collectively, the "HashWhale Platform"). By accessing or using the HashWhale Platform, you acknowledge and agree to be bound by this Agreement. If you do not agree with the terms, please refrain from using the services provided by HashWhale.

In the event that you purchase any products offered by HashWhale, you are also required to accept and comply with the relevant service agreements specific to those products.

HashWhale reserves the right to amend this Agreement at any time at its sole discretion. It is the user's responsibility to review this Agreement periodically to stay informed of any updates. Any revisions to the Agreement will take effect immediately upon publication, unless otherwise stated. Continued use of the services after the publication of any revisions constitutes acceptance of the modified terms.

I. Service Overview

HashWhale provides a range of services through its proprietary system, made available via the Internet and other platforms.

II. Provision, Modification, and Termination of Services

Acceptance of Services and Information

By using HashWhale's services, the user agrees to receive various information services provided by HashWhale. The user grants permission to HashWhale to send business-related information to the user's email, mobile phone, mailing address, and other contact points. Users have the ability to update their contact information and preferences by accessing the relevant pages on the HashWhale Platform.

User Rights in Case of Disagreement or Dissatisfaction

If the user disagrees with modifications to this Agreement or is dissatisfied with the services provided by HashWhale, the user may:

a. Cease using HashWhale's web services

b. Notify HashWhale through customer service or other channels to discontinue the services

Upon termination, the user's access to the HashWhale services will be immediately revoked. In such a case, HashWhale is not obligated to provide any unprocessed information or incomplete services to the user or any third parties not directly involved.

Refund Policy

Once the user has made a purchase of products or services through the HashWhale Platform, HashWhale reserves the right to refuse any refund requests based on reasons attributable to the user.

III. User Registration

User Representations and Warranties

By using HashWhale's services, the user represents and warrants the following, which will be deemed as renewed each time the user accesses HashWhale's services: a. If the user is an individual, they confirm they are at least 18 years old and possess full legal capacity

b. If the user is a legal entity, they confirm that the entity is duly established and validly existing in accordance with the laws and regulations of its jurisdiction and has a good reputation

c. The user agrees to use HashWhale's services in compliance with the applicable laws, regulations, and policies of their country or region, and acknowledges that they will not breach any obligations to third parties

d. The user has the necessary authority to use HashWhale's services and to fulfill all relevant obligations, and that this Agreement, along with any associated service agreements, is legally binding upon them

User Registration Information

The user agrees to:

a. Provide truthful, accurate, and complete personal or entity information when registering

b. Update their registration information promptly in case of any changes

c. Unless prior written consent is obtained from HashWhale, users are permitted to register only one account

d. For compliance purposes, including KYC and AML regulations, HashWhale reserves the right to request the account owner's identification and/or financial information

e. Protect account credentials; report unauthorized use immediately. HashWhale is not responsible for unauthorized use and associated consequences

IV. Confidentiality of Information

Definition of User Information

"User information" refers to information that complies with relevant laws, regulations, and policies, including:

a. Personal information provided by the user during the registration process

b. Information automatically collected by HashWhale when a user interacts with the platform, including but not limited to IP addresses, cookies, and browsing records

c. Personal information legally obtained by HashWhale from its business partners

d. Other personal information acquired through legal means

Confidentiality Commitment

HashWhale commits not to disclose the user's password, name, phone number, or other confidential information to any third party unless required by law or with the user's prior consent.

Disclosure of Personal Information

HashWhale may disclose the user's personal information in the following legal circumstances:

a. Disclosure with the user's consent or to authorized third parties as directed by the user

b. Disclosure as required by laws, regulations, or administrative authorities to relevant government or judicial bodies

c. Other disclosures made by HashWhale in compliance with applicable laws, regulations, and policies

V. Risk Notice

Before purchasing any service provided by HashWhale, users should assess whether the service aligns with their financial capacity and risk tolerance. By proceeding with a purchase, you acknowledge and accept all risks associated with the service. The following list outlines certain risks, though it is not exhaustive, and other risks may arise in the future that could result in financial loss, prevent you from receiving benefits, or lead to the termination of services:

a. Digital Asset and Related Product Risks:

The use of digital assets or related products and services involves potential financial, regulatory, and other risks. You should ensure that you have sufficient knowledge and experience with blockchain technology, digital assets, and the risks associated with smart contracts. Any decision to participate in digital asset activities and/or use related services should be based on independent research and/or professional advice. HashWhale assumes that you are a professional with an understanding of the digital asset industry and its risks. This Agreement and HashWhale's services are not to be interpreted as investment advice.

b. Factors Affecting Value:

The value of any product or service offered by HashWhale, as well as any digital asset, may be influenced by numerous factors beyond HashWhale's control, such as changes in mining difficulty, fluctuations in the market price of digital assets, obsolescence of hardware, or hardware depreciation.

c. Volatility of Digital Assets:

Given the nature of digital assets, their value can decline rapidly and potentially reach zero at any time. You acknowledge that the value of digital assets may fluctuate significantly. HashWhale will not be liable for any losses incurred due to market price changes.

d. Transaction Confirmation Delays:

Confirmation of digital asset transactions can take time, and in rare instances, may fail, leaving the transaction incomplete.

e. Irreversibility of Transactions:

Digital asset transactions are irreversible. If you send digital assets to the wrong recipient or address, the transaction cannot be undone or the funds recovered.

f. Funds and Payment Methods:

HashWhale does not hold users' funds. To purchase products and services, users may opt to pay using digital assets or "Whales". "Whales" can be purchased in advance and used for platform orders and service fees. Since "Whales" are non-refundable and non-withdrawable, users should assess their future needs before purchasing and buy them in moderation.

g. Loss of Access Due to PIN/Password Issues:

If you lose or forget your PIN or password required for accessing digital assets, such assets may be lost or inaccessible.

h. Blockchain Technology Limitations:

Blockchain or digital asset technologies may contain inherent, unknown technical flaws that could affect their performance or security.

i. Regulatory Changes:

Countries may enact new laws, regulations, or policies that could impact the use of digital assets.

j. System Maintenance and Interruptions:

HashWhale may periodically maintain or upgrade its system. You acknowledge that HashWhale cannot guarantee uninterrupted service and will not be liable for losses due to any service interruptions or delays caused by system maintenance or upgrades unless otherwise agreed upon.

k. Security Risks:

No authentication, security, or other technical measure is completely secure or error-free. By using our services, you acknowledge and accept all risks of unauthorized access, hacking, identity theft, and other security breaches.

l. Official Communication Channels:

You understand that HashWhale reserves the right to provide updates or notifications related to services via official channels, such as its website, email, client server calls, SMS, etc. HashWhale is not responsible for information received through unofficial channels. If you have doubts about the authenticity of any communication claiming to be from HashWhale, please contact us immediately.

VI. User Rights

a. Username, Password, and Account Security

Users may choose whether to register for HashWhale. Upon registration, they are responsible for creating their account in compliance with applicable laws and online norms, and must avoid any offensive or unlawful content in their account name or activities.

After registration, users must keep their account (email or phone number) and password confidential. They are fully responsible for all actions taken under their account and any resulting legal consequences. If a password is forgotten, it can be reset using the link sent to the registered email.

b. Participation in Activities

Users have the right to participate in various online and offline activities organized by HashWhale.

c. Access to Additional Services

Users have the right to enjoy various other services provided by HashWhale in accordance with platform rules.

d. Service Issues and Resolution

HashWhale promises that if it is unable to provide services to the user due to reasons on HashWhale's part, it will offer alternative solutions. If no solution is available, HashWhale will bear responsibility for any losses incurred by the user. The specific amount of compensation will be determined through mutual agreement. Users may contact HashWhale's official customer service at support.hashwhale.io.

VII. User Restrictions and Obligations

Malicious Account Registration

Users are prohibited from registering multiple accounts for malicious purposes such as profit, speculation, cash-outs, or rewards. Users are also forbidden from stealing other users' accounts. HashWhale reserves the right to suspend or terminate services to users who violate these provisions and take necessary legal actions as permitted by applicable laws and regulations.

Account and Security Responsibilities

You are responsible for maintaining the security of your HashWhale account, password, SMS verification code, and email verification code. Any legal consequences arising from the leakage or loss of this information due to your own actions will be your responsibility. HashWhale is not liable for any damage caused by such disclosures.

Prohibited Use of HashWhale for Illegal Activities

You may not use the HashWhale platform for any illegal activities. Without HashWhale's authorization, you are prohibited from using the platform for commercial activities or using HashWhale's materials or information for such purposes.

Compliance with Laws and Regulations

You agree to comply with all applicable laws, this Agreement, and all rules and policies regarding the use of HashWhale's services. You must not use the services in any manner prohibited by law.

Tax and Other Expenses

You are responsible for any taxes, as well as any hardware, software, service, or other expenses incurred while using the services provided by HashWhale.

Personal Use of Services

You agree to use HashWhale's services solely for your own benefit and not on behalf of others or for third-party gain.

Reporting Fraud or Misconduct

If you suspect fraud or misconduct by any third party using HashWhale's services, you agree to contact HashWhale immediately.

Security and Service Integrity

You are prohibited from engaging in activities that could affect the security of HashWhale's services or website.

IP Masking Restrictions

You may not use methods to mask your internet traffic or IP address, such as using proxies, Tor, VPNs, or other techniques that conceal your true internet connection.

Intellectual Property Rights

All intellectual property rights related to the content displayed on the HashWhale website, including articles, images, news, materials, website structure, layout, and design (unless otherwise stated), are owned by HashWhale or its licensors. Users must respect these intellectual property rights.

Reputation and Legal Liability

You agree that your use of HashWhale's services will not damage its reputation or expose it to legal liability, fines, or other penalties.

Account Closure

You may close your account at any time, but you are still responsible for fulfilling any pending transactions and any fees incurred before account closure.

Restricted Persons

HashWhale's services are not available to the following "restricted persons":

a. Residents of the US, Hong Kong, mainland China, the Crimean region, Cuba, Iran, North Korea, and Syria.

b. Entities or individuals subject to restrictions under applicable trade sanctions or export compliance laws.

c. Any other entity or individual not in compliance with HashWhale's internal risk control policies.

This list may not be exhaustive. Before using HashWhale's services, please confirm that you are not a restricted person. If you are a restricted person and use HashWhale's services, you assume all legal risks and liabilities. HashWhale reserves the right to refuse service to restricted persons and will not refund any money.

VIII. Liability for Breach of Contract

User Violations

In the event of any violation of this Agreement by the user (including but not limited to failure to pay the package fee on time, or if the use of HashWhale's services is illegal in the user's country/region), HashWhale reserves the right to immediately suspend or terminate the provision of services and take all necessary legal actions permitted by applicable laws and regulations, including but not limited to seeking compensation from the user for losses incurred by HashWhale.

Suspension of Services

If HashWhale reasonably suspects that the user has used the services in an illegal, fraudulent, or improper manner, HashWhale reserves the right to suspend services to the user until the user can provide proof of compliance with HashWhale's requirements. HashWhale is not responsible for any losses resulting from the suspension of services during this time.

IX. Disclaimer

Limitations of Liability

HashWhale's liability for the products it provides is limited by the service agreement for each product. Unless otherwise agreed, HashWhale's total liability to the user shall not exceed the total fees paid by the user to HashWhale.

Service Interruption and Force Majeure

Due to the nature of the Internet, HashWhale does not guarantee uninterrupted service, nor does it guarantee the timeliness or security of the service. HashWhale is not liable for any service interruptions caused by events beyond its control, including but not limited to war (declared or undeclared), terrorist activities, sabotage, blockades, fires, lightning, natural disasters, strikes, riots, civil unrest, epidemic prevention restrictions, epidemics, earthquakes, floods, hurricanes, explosions, and regulatory or administrative actions. In such cases, HashWhale will take reasonable steps to minimize disruption, but shall not be liable for any resulting consequences.

User Information

HashWhale is not responsible for the preservation, modification, deletion, or storage of information posted by users.

Accuracy and Reliability of Content

Unless expressly agreed upon in writing by HashWhale, HashWhale does not guarantee the accuracy, completeness, or reliability of any content obtained by users through the website, including but not limited to advertisements. HashWhale is not responsible for any products, services, information, or materials purchased or obtained based on the content available on this website. Users assume all risks associated with using this information.

Communication of Notices

All notices sent to users by HashWhale will be delivered through official page announcements, in-app messages, emails, customer service calls, SMS, or regular mail. HashWhale is not responsible for any winnings, promotions, or information not obtained through official channels.

Exclusions of Liability

The user acknowledges and agrees that, unless HashWhale expressly agrees in writing, HashWhale shall not be liable for the following situations or the resulting losses:

a. Loss of trading profits.

b. Damage or loss of information/data not caused by intentional misconduct by HashWhale.

c. Products or services being removed from the market.

d. Changes in laws, regulations, or policies.

e. Non-compliance with HashWhale's compliance obligations or internal risk control policies based on information provided by the user (such as identification, financial information, or digital asset wallet addresses).

f. Losses resulting from user fault or breach of this Agreement (including, but not limited to, providing inaccurate information, leaking passwords, etc.).

g. Any other events beyond HashWhale's control.

Indemnification

You agree to indemnify and defend HashWhale against any loss, liability, claim, accusation, action, or expense (including reasonable attorneys' fees) arising from your breach of this Agreement. In no case shall HashWhale, its affiliates, officers, directors, agents, employees, or representatives be liable to you or any third party for any special, incidental, indirect, or consequential damages or loss of profits related to this Agreement.

X. Other Agreements

Waiver

A delay or failure by the Company to exercise any of its rights or remedies regarding any breach by a user under this Agreement shall not be construed as a waiver or acceptance of such breach by the Company.

Severability

If any provision of this Agreement is found to be illegal or unenforceable, it shall not affect the validity of the remaining provisions, which will remain in full force and effect.

Applicable Law

This Agreement shall be governed by the laws of Singapore in its entirety, without regard to its conflict of laws principles.

Conflict Choice

This Agreement is made between the Company and users who are registered and use the Company's services.

Dispute Resolution

You acknowledge and agree that, prior to filing any dispute or claim, you will contact us via support@hashwhale.io to attempt to resolve the dispute informally. We will make every effort to resolve the dispute internally as quickly as possible. Both parties agree to resolve any disputes in good faith through negotiation (such negotiations shall be confidential and protected by applicable rules, and shall not be used as evidence in any subsequent legal proceedings unless otherwise agreed).
